By listing items or participating in exchanges on SmartXchange, you agree to the following usage policies regarding your listings and community interactions.

Honest Representation & FTC Compliance

In accordance with the **FTC Act** and consumer protection laws, SmartXchange strictly prohibits deceptive or misleading claims. All users must ensure that:

  • **Accuracy:** All descriptions, photos, and conditions must represent the item as it exists at the time of the listing.
  • **No Misleading Claims:** You must not misrepresent the brand, age, or functionality of an item to induce a trade or sale.
  • **Transparency:** Known defects, repairs, or missing parts must be explicitly disclosed in the item description.

Violation of these transparency standards will result in immediate account suspension and a permanent lock on your SmartScore.

1. Listing Accuracy

You must provide accurate and complete descriptions for every item you list. This includes details about the item's condition, age, brand, and any known defects or issues. High-quality, original photos of the actual item are required.

2. Genuine Used Goods & Warranty of Title

SmartXchange is exclusively for the rehoming of **used goods**. You warrant that:

  • All items are authentic pre-owned items. Counterfeit goods are strictly prohibited.
  • You have the full legal right and title to rehome the items. Listing stolen property is a violation of law and this Policy.
  • Items are not subject to any third-party liens or encumbrances.

3. INFORM Consumers Act Compliance (U.S.)

Legal Disclosure:

In accordance with the **INFORM Consumers Act (2023)**, high-volume users (as defined by the Act) must provide and verify specific information, including bank account details, tax identification numbers, and contact information.

By listing items on SmartXchange, you agree to provide accurate identification and contact information. If you reach certain transaction thresholds, SmartXchange is legally required to verify this information through our ID Verification system to maintain community safety and transparency.

4. Indemnification

Release of Liability:

You agree to indemnify and hold SmartXchange harmless from any claims, damages, or losses arising from your listings, including but not limited to claims of copyright infringement, trademark infringement, or the listing of stolen/counterfeit items.

5. Fulfillment and Communication

Once an exchange is agreed upon, you are expected to communicate promptly with the other party. You must arrange for pickup or drop-off within the timeframe agreed upon in the exchange workflow.

6. Pro Member Responsibilities

Users on Pro plans must maintain a high standard of community participation to retain their verified status and featured placement. Excessive disputes or slow fulfillment may result in removal from featured sections.
